  1. GENERAL PROVISIONS
  1. These Terms and Conditions („Terms”) define the terms and conditions of a hackathon organized under the name Zero Hunger Hackathon (“Hackathon”).
  2. The Organizer of the Hackathon is Tech To The Rescue Foundation, with its registered office at Hoża 86/410, 00-682 Warsaw, Poland, entered into the Register of Associations, Other Social and Professional Organizations, Foundations, and Independent Public Health Care Facilities kept by the District Court for the Capital City of Warsaw, XIII Commercial Department of the National Court Register under KRS number 0000937683, NIP (Tax Identification Number) 5272981322 („Organizer”), which may be contacted by sending a message to the following e-mail address: [email protected].
  1. DEFINITIONS

For the purpose of these Terms, the following terms shall have meanings ascribed to them below:

  1. Application – an application sent by the Company via dedicated form on the Website; 
  2. Attendees or Attendee – means to understand collectively Participants, people representing Nonprofits and Mentors; 
  3. Assessment platform – website at the electronic address: https://www.techtotherescue.org/hackathon/, used to upload and store projects created as part of the Hackathon;
  4. Challenge – problems identified by nonprofit organizations, submitted to the Hackathon for developing solutions, from which each Team chooses the problem on which to work during the Competitions;
  5. Communication platform – a dedicated application available at https://discord.com used for contact between Participants, Mentors, Organizers, etc., during the Hackathon;
  6. Company – a technology company that is interested in having its employees or associates (regardless of the legal basis of employment) participate in a Hackathon competition;
  7. Competitions – the competitions are an integral part of the Hackathon, where Participants compete to develop the best solutions to the Challenges posed by nonprofit organizations;
  8. Mentor – shall mean an adult entitled to participate in the Hackathon and receive the role of mentor. The mentor may also play the role of a Judge for the Competitions;
  9. Nonprofit – shall mean a not-for-profit organization that has submitted a Challenge to the Hackathon;
  10. Participant – shall mean an adult, with full legal capacity, representing a Company, entitled to participate in the Hackathon;
  11. Partner – shall mean a company participating in the Hackathon, presenting its products and services. A Partner may act as a Sponsor;
  12. Registration – registration of Participants to participate in the Competition;
  13. Schedule – shall mean a detailed Hackathon schedule determined by the Organizer, made available on the Website. The Schedule is indicative and is subject to change;
  14. Sponsor – shall mean an individual or a company funding awards in the Competitions organized as part of the Hackathon;
  15. Solution – the solution to the problem presented in the Challenge that the Team has chosen, presented in programmatic form by the Team for evaluation by the judges;
  16. Team a team of Participants performing together in the Competition on behalf of the same Company;
  17. Website – shall mean the website available at https://www.techtotherescue.org/hackathon/zero-hunger/, containing information on the Hackathon and enabling registration for participation in the Hackathon as a Participant.
  1. THE HACKATHON
  1. The Hackathon shall be held in real-time, online and it’s organized in English.
  2. The Hackathon will start on the 22nd of May  2024 at 4:00 p.m. (CET) and will end on the 24th of May 2024 at 7:00 p.m. (CET) with the announcement of the results.
  3. Competitions will be held at the time and place of the Hackathon to provide Solutions to the problems presented.
  4. As part of the Hackathon, the Organizer reserves the right to organize additional activities such as workshops or lectures, etc. in accordance with the Schedule.
  5. Please be informed that the Hackathon schedule assumes that Participants will perform activities of high intensity for more than 24 hours. The Participant should reasonably assess, and in the event of any concerns – consult a physician about whether his or her health allows him or her to participate in the Hackathon.
  6. Unless otherwise stated in these Terms, communication between the Organizer and the Participants and Teams will be carried out electronically, to the Participant’s e-mail address indicated in the registration form, and to the following Organizer’s e-mail address: [email protected], or any other address in the techtotherescue.org domain or Discord Platform.
  1. PARTICIPANTS AND TEAMS
  1. Participation in the Hackathon is free of charge.
  2. The Hackathon Participants may be adult natural persons with full legal capacity.  The Hackathon has an international character so that Participants can be from all over the world, with the reservation of paragraph 3. 
  3. The Hackathon is not allowed to be attended by participants or organization from:
  1.  countries that are embargoed by the US or the EU,
  2. a country, state, region, province, or territory where the laws of the United States or local law prohibits participating or receiving a prize in the Hackathon (including, but not limited to, the Argentinian provinces of Mendoza, Neuquén, Rio Negro, Salta, and Tierra del Fuego, Brazil, Crimea, Cuba, China France, Hong Kong, Italy, Iran, North Korea, the province of Quebec, Russia, Syria, and any other country/region designated by the United States Treasury’s Office of Foreign Assets Control),
  3. Cuba, Iran, North Korea (the Democratic People‘s Republic of Korea), Syria, Crimea region means the so-called Donetsk region of the People’s Republic (DNR) and the so-called Lugansk region of the People’s Republic (LNR)*.
  1. Participants compete in Teams. Teams include only of Participants from the same Company.
  2. Each Team consists of up to 6 Participants. It is possible to participate individually (1 team member). Each Participant can be part of only one Team.
  3. Participants are matched into Teams at their discretion, after the presentation of Challenges, mentioned in section VIII point 7. 
  4. More than one Team can compete on behalf of each Company. 
  1. THE COMPANY’S APPLICATION 
  1. Each Company, in order to declare interest in the Hackathon, must send the Application to the Organizer via a dedicated form available at the following URL address: https://www.techtotherescue.org/hackathon/zero-hunger/
  2. Application for Company shall begin on the 23rd of March 2024 at 9:00 pm (CET) and end on the 15th of May 2024 at 11:59 pm (CET). The Organizer reserves the right to extend the deadline of the application.
  3. Application is made by completing the application form and sending it to the Organizer by pressing the “Register my company” or similar button.
  4. The condition for sending the Application is accepting these Terms by checking the dedicated checkbox (obligatory). These Terms will also be provided in electronic form on the Website.
  5. Submitting the Application also means that the person who sends the Application on the Company’s behalf has read the Privacy Policy and he/she is authorized to act on behalf of the Company. 
  6. Sending the Application implies the Company’s consent to receive organizational information during the Hackathon via the address e-mail indicated in the form, which is necessary to ensure the conduct of the Hackathon. 
  7. As part of the sign-up form, you can also give your voluntary consent to join our newsletter or join our initiative in accordance with the Terms of Service.
  8. After submitting the Application form, the Organizer will send to the Company a confirmation of application  to the email address provided in the form. The confirmation will include a link  that should be forwarded by the Company to all Participants from this Company, in order for them to register their participation in the Hackathon in accordance with point VI. 
  9. By applying for the Hackathon the Company grants the Organizers a right to share information about the Company in publications related to the Hackathon.
  10. The Organizer may refuse the Company’s participation in the Hackathon by persons reasonably suspected to have registered for a purpose other than to participate in the Competitions organized as part of the Hackathon (in particular to recruit employees). In such an event, the application shall be deemed ineffective, about which the Organizer will inform the Company.  The exclusion of the Company means the automatic exclusion of all Participants from this Company who have registered their participation in the Hackathon. 
  1. REGISTRATION FOR PARTICIPANTS
  1. Participation in the Hackathon shall be subject to the registration of a Participant. 
  2. In order to register for the Hackathon the Participant should use the dedicated link sent to the Companies after submitting the Application according to section V. 
  3. Registration for Participants shall begin on the 23rd of March 2024 at 9:00 pm (CET) and end on the 15th of May 2024 at 11:59 pm (CET). The Organizer reserves the right to extend the registration deadline.
  4. During the registration, the Participant shall provide the following data: first name and surname, e-mail address, telephone number, company name, and company website address.
  5. Registration for Participation is made by completing the registration form and sending it to the Organizer by pressing the “Sign up” or similar button.  After registration the Organizer will send to the Participant a confirmation of registration to the email address provided in the form.
  6. The condition for registering participation in the Hackathon is accepting these Terms by checking the dedicated checkbox (obligatory). These Terms will also be provided in electronic form on the Website.
  7. Submitting the registration form also means that the Participant has read the Privacy Policy.
  8. Registration of participation in the Hackathon implies the Participant’s consent to receive organizational information during the Hackathon through the provided communication channels, which is necessary to ensure the conduct of the Hackathon. 
  9. The Organizer may refuse participation in the Hackathon by persons reasonably suspected to have registered for a purpose other than to participate in the Competitions organized as part of the Hackathon (in particular to recruit employees). In such an event, registration shall be deemed ineffective, about which the Organizer will inform the Participant.
  1. MENTOR
  1. During the Competitions, the Organizer may allow Mentors to participate. The Mentor can be an adult natural person with full legal capacity who has experience and knowledge of programming or food security subject expertise in the areas indicated in the enrollment form at a level to provide assistance and support to the Teams.
  2. Mentors provide an advisory role to the Teams during all the time of Competitions in an online form.  
  3. Teams are entitled to consult the Solution and any problems with Mentors. 
  4. It is forbidden for the Mentor to make any changes to the source code of the Solution in favor of the Participants. Violation of the above-mentioned prohibition is grounds for exclusion of the Team and Mentor from participation in the Hackathon, including Competitions. 
  5. Individuals interested in being Mentors are required to fill out a dedicated form received from the Organizer. For this purpose please contact with Us via the following address e-mail: [email protected].  
  6. Application is made by completing the application form and sending it to the Organizer by pressing the “Sign up as a Mentor” or similar button.
  7. The condition for sending the form is accepting these Terms by checking the dedicated checkbox (obligatory). These Terms will also be provided in electronic form on the Website.
  8. Submitting the registration form also means that the Mentor has read the Privacy Policy.
  9. Sending the form implies the Mentor’s consent to receive organizational information during the Hackathon through an address e-mail indicated in the form, which is necessary to ensure the conduct of the Hackathon. 
  10. After submitting the form, the Organizer will send to the Mentor a confirmation of application to the email address provided in the form.
  11. The Organizer has the right to refuse the participation of the Mentor in the Hackathon if, after verification, it is found that the applicant does not meet the condition specified in section VIII point 1 above.
  12. The Organizer may refuse the Mentor’s participation in the Hackathon by persons reasonably suspected to have registered for a purpose other than to participate in the Competitions organized as part of the Hackathon (in particular to recruit employees). In such an event, application shall be deemed ineffective, about which the Organizer will inform the Mentor. 
  13. By application for the Hackathon the Mentor grants the Organizers a right to share information about the Mentor in publication related to the Hackathon. 
  14. The Mentor is obliged to provide the Organizer with his photo and a bio according to the Organizer’s guidelines within the timeframe agreed upon with the Organizer. At the same time, the Mentor hereby grants to the Organizer non-exclusive and gratuitous consent to disseminate his/her image without the time and territorial limitations, in the following fields of exploitation e.g., preservation and reproduction of the Mentor’s image and bio by printing, reprographics, computer-writing, magnetic, analog, audiovisual, digital, placing and sharing on the computer networks and in telecommunication networks, public performance displaying, displaying, re-broadcasting, playing, publicly sharing in a way that allows anyone to access at a time and in the place chosen by him, in any technology,  in the following publication formats: the Organizer’s websites and social media platforms, email newsletter, publishing and promotional publications, in printed and electronic materials for Organizer’s in-house purposes or information nature. The Mentor’s consent comprises the dissemination of the image, including statements (voice), in its entirety, as well as in fragments, independently or in the works of other entities, and also in connection with the works of other entities (dissemination after development). The consent may be revoked or changed by the Mentor at any time in the following way: [email protected]. The withdrawal of consent does not affect the legality of the processing of the image before its withdrawal.
  1. NONPROFITS
  1. The Organizer, in cooperation with the chosen NGOs (by the Organizer), selects Challenges related to the theme of a particular edition of Hackathon. The condition of cooperation between the Organizer and the selected NGO within the Hacathon is the acceptance of these Terms and conditions by the NGO in a manner agreed with the Organizer.
  2. The Organizer is free to decide which NGOs it will cooperate with for the Hackathon.
  3. The NGO’s decision to cooperate with the Organizer in the Hackathon is equivalent to acceptance of these Terms and conditions. 
  4. The Nonprofit grants the Organizers a right to share information about the Nonprofit in publications related to the Hackathon.
  5. The Organizer may refuse to Nonprofit the participation in the Hackathon if there is a reasonable suspicion that the NGO  cooperates with the Organizer for the purpose of recruiting employees or for unlawful or immoral purposes.
  6. Nonprofit is obliged to:
    • designate a person who will represent the Nonprofit during the Hackathon;
    • required to prepare a presentation of the submitted Challenge, based on the presentation template provided by the Organizer, to be presented to the Participants at the start of the Hackathon;
    • has at least one representative available online during all days of the Hackathon at least in the timeframe between 4:00 pm – 9:00 pm (CET) on the 22nd of May 2024, 2:00 p.m. – 9:00 pm (CET) on the 23rd of May 2024 and 2:00 pm – 9:00 pm (CET) on 24th of May, to answer questions from Participants; 
    • provide data sets, resources, or materials for Participants if needed to be able to work on the Challenge;
    • provide a minimum of 1 Judge to participate in the judging of the Competition for the Challenge submitted by the Nonprofit. The Organizers will provide training and guidelines for the Judges to ensure a fair and objective judging process;
    • implement the Solution to the Challenge that won the Competition. Implementation should involve the practical use of the Solution, integrating it with the activities of the non-profit and using its advantages;
    • report on the impact of the implemented Solution on their organization’s operations within three months from the implementation. The impact report should outline the specific changes, improvements, or efficiencies achieved as a result of the implemented Solution, including any quantifiable metrics or qualitative observations. The report should be submitted to the Organizers in digital form at the email address: [email protected];
    • declare availability for the media in case of possible requests for interviews and quotes related to the Hackathon.
  1. COMPETITIONS
  1. During the Hackathon, a number of Competitions independent of each other shall be held, as part of which solutions will be developed for Challenges.
  2. Challenges shall involve IT problems for which a Team will be expected to develop an original solution. The subjects of the Challenge will be presented in the description of a given Challenge.
  3. The Hackathon Challenges will focus specifically on food security issues. However, the Organizer reserves the right to provide Challenges concerning another area.
  4. Each Team can choose more than one Challenge for which they will prepare Solutions (participate in more than one Competition).
  5. The number of Challenges is decided by the Organizer. 
  6. The list of Competitions shall be published at https://www.techtotherescue.org/hackathon/zero-hunger/ no later than the opening of the Hackathon.
  7. Each Competition shall begin with the presentation of a Challenge by the nonprofit organization, The Organizer, the Sponsor, or a person designated by the Organizer.
  8. Once the subject of the Challenge is announced, Participants shall have until 24th of May 2024, at 2:59 pm (CET), to provide a relevant Solution.
  9. Participants can use the support of Nonprofits that have submitted a particular Challenge the Team is working on and Mentors during the Competitions.
  10. The manner of submission of a Solution to a given Challenge is by uploading it to the Assessment Platform. Detailed instructions will be provided during the launch of the Hackathon.
  11. The Assessment Platform will be made available to the Participants after the presentation of Challenges at 6:00 pm (CET) on 22nd May 2024.
  12. It is required that one Participant from the Team has a registered account on the Assessment Platform. In this case, along with the publication of the Solution on the Assessment Platform, the registered Participant posts the data of the other members of the Team (name, surname, e-mail). All Team members can also register on the Assessment Platform – then the team leader attaches the other registered participants to the Solution on the Assessment Platform.
  13. The Teams must ensure that they register on the Assessment Platform in accordance with point 12 above at a time allowing them to publish the Solution before the end of the Competition.
  14. After the lapse of the period specified at point 8 above, no further modifications and corrections shall be made to the developed Solution. Any modifications and corrections made after the lapse of the specified period shall not be taken into consideration by the Judges.
  15. The results of the Competitions shall be announced online in real-time in the manner indicated by the Organizer during the Hackathon on 24th May  2024 at 7:00 pm (CET). The results will also be published on a dedicated channel on Discord, on the Website, and on the Organizer’s social media. The result can also be published by Sponsors and Partners. 
  1. PANEL OF JUDGES AND EVALUATION CRITERIA
  1. Each Solution shall be evaluated by the panel of Judges designated for a given Challenge.
  2. Each panel of Judges consists of at least two Judges. Judges shall be appointed by the Sponsor or the Nonprofit, or the Organizer. 
  3. The Judges assessment of the Solutions according to the solution’s innovation, usefulness, easiness of deployment, and maintaining safety, completeness, and quality of the Solution.
  4. The Judges selects a maximum of three (3) Teams whose Solution received the highest score, with the proviso that he has obtained at least 50% of the maximum points. If the Solutions developed by the Team do not score at least 50% of the maximum number of points, prizes need not be awarded.
  5. The chosen Teams, mentioned in point 4 above, will present their Solution in front of the Judges at the appointed time. During the presentation, the Judges are entitled to ask questions related to the Solution. After the presentations, the Judges select the winning Team, which will receive the awards.
  6. Decisions of the Judges are made by a simple majority of votes. In the event of an equal distribution of votes, the decision of the Chairperson of the panel of Judges, elected by the Judges from among its members before the beginning of the Competition, is binding.
  1. AWARDS
  1. Each Team that has won in the particular Challenge, in accordance with section 10 point 4, gains the right to choose a non-profit organization (that needs to be legally registered in its country of origin, non-discriminatory and operating in the area of food security) to which the Organizer will make a cash donation in the amount of 1.000,00 USD. 
  2. The donation will be donated to the nonprofit organization chosen by the winning Team within 180 days of the nonprofit organization’s designation.  
  3. The winning Team’s right to designate a nonprofit organization in accordance with point 2 above expires if it is not realized by the winning Team within 30 days of the announcement of the Competition results. 
  4. The Organizer reserves the right to verify the legal registration of the chosen nonprofit organization and may request additional information to confirm the legitimacy of the donation.
  5. The right mentioned in point 1 above, shall not be exchanged for monetary awards, other prizes, or cash equivalents.
  6. Awards shall be granted only to winning Teams. However, the Sponsors and the Organizer reserve the right to award distinctions and additional minor prizes to specific Teams whose projects will be considered valuable by the Organizer or by the panel of judges. In the event of any doubts, Section 11 shall not apply to the teams that are awarded a distinction.
  1. IMPLEMENTATION OF THE SOLUTION

Of all the winning Teams, a maximum of 3 Solutions may also be selected by the Sponsor or/and Partners, for the implementation of which partners and/or sponsors will donate up to $10k of budget for low bono implementations to the non-profit organizations for which these Solutions were dedicated in the Challenges. 

  1.  THE ATTENDEES’ IMAGES DURING THE HACKATHON
  1. The Organizer declares that the Hackathon will be recorded in the form of audio-visual recording and/or photographs, and the works created in this way will be used for broadcasting in the mass media (television, radio, Internet, press, etc.) or for information, and promotion purposes by Organizer.
  2. The  Attendees by registering and participating for the Hackathon hereby grants to the Organizer, Partners and Sponsors, non-exclusive and gratuitous consent to the recording and publication of his/her image in connection with participation in the Hackathon, without time and territorial limitations, in the following fields of exploitation e.g. preservation and reproduction of their  image or statements (voice), or its fragments by printing, reprographic, computer-writing, magnetic, analogue, audiovisual, digital, placing and sharing on the computer networks and in telecommunication networks, public performance displaying, displaying, re-broadcasting, playing, publicly sharing in a way that allows anyone to access at a time and in the place chosen by him, in any technology,  in the following publication formats: the Organizer’s websites and social media platforms, email newsletter, publishing and promotional publications, in printed and electronic materials for Organizer’s inhouse purposes or information nature.
  3. The Attendees’  consent comprises the dissemination of the image, including statements (voice), in its entirety, as well as in fragments, independently or in the works of other entities, and also in connection with the works of other entities (dissemination after development).
  4. The consent may be revoked or changed by each Attendee at any time in the following way: [email protected]. The withdrawal of consent does not affect the legality of the processing of the image before its withdrawal.
  1. INTELLECTUAL PROPERTY RIGHTS TO THE SOLUTION
  1. The Solutions created as part of the Hackathon may involve intellectual property rights, including copyrights.
  2. Each Participant, signing up to the Hackathon, shall ensure that the Solution and it’s parts, submitted to Organizer are original works, free from legal defects and from any encumbrances, and they do not infringe the provisions of law nor the rights or interests of third parties, and the Participant shall be entitled to exclusive and unlimited moral right to them. Furthermore, each Participant shall declare that it is not a member of any organization for collective copyright management and that it shall have the right of disposition of rights to the Solution and its parts personally without the mediation of any third parties, including an organization for collective copyright management without any limitations.  
  3. The winning Teams, according to the section, are required to make the Solution available to the non-profit organization which prepared the Challenge, under an open-source license for use by that organization.
  4. The copyrights referred to in the abovementioned point 3, shall be transferred in the following fields of use:
    1. permanent or temporary reproduction of the Solution, in whole or in part, by any means and in any form,  in particular for the purpose of loading, displaying, running, transmitting and storing the Work, as well as production of their copies with the use of any technology, including printing, reprographics, magnetic fixing, and digital technology;
    2. translation, adaptation, arrangement, and any other changes,
    3. dissemination, introduction to trade or renting the Solution or a copy thereof,
    4. use of all available and technically feasible functionalities of the Solution, in accordance with its socio-economic objective,
    5. dissemination of the Solution different from defined in (4) above, in particular making the Solution available to the public in such a way as to allow anyone to access it at a place and time selected by them.
    6. permitting third parties to exercise their derivative copyrights related to the Solution.
  5. The agreement referred to in point 3 will be negotiated between the winning Team and the non-profit organization. The Organizer is not responsible for the terms agreed between the parties.
  6. The winning Teams are committed to making the Solutions available in accordance with point 3 no later than 30 days from the date of the end of the Hackathon. 
  7. The Participants shall be authorized to use during the Competition components of computer programs licensed under free-software license („open source” software) and to use other components only if the use of such computer programs to produce Solution does not prevent Participants from transferring the copyright to the Solutions under the rules specified in this section, and in particular in the indicated fields of exploitation. By posting the Solution on the Assessment Platform, the Team is jointly and severally obliged to correctly and in accordance with the law and common practice, mark the parts of the Solution based on open source with an indication of the corresponding license. 
  1. THE HACKATHON LECTURES
  1. Various side events, including lectures, will be held during the Hackathon. The schedule of the events shall be specified in the agenda of the Hackathon. 
  2. As part of the events, Attendees can gain access to third-party copyrighted materials, including speakers.
  3. It is forbidden for Attendees to record lectures independently and distribute them in any form. Recordings of lectures may be made available by the Organizer in the manner indicated by the Organizer.
  4. The Organizer, by sharing lecture recordings, grants to the Attendees non-exclusive, without territorial or time limitations, sublicense to  playback the recordings at the place and time of the Attendee’s choosing, exclusively for personal use, for non-commercial purposes. 
  5. The Organizer may terminate  the Attendees’ sub-license at any time, in the event that the Organizer is notified and the terms of the sub-license are violated by the Attendee, or the speaker terminates the license to the Organizer.
  1. RESPONSIBILITY OF THE ORGANIZER 

To the extent permitted by law, the Organizer is not responsible for:

  1. acts and omissions of telecommunications carriers and service providers used by the Attendees,
  2. interruptions or difficulties to participation in the Hackathon caused by necessary technical interruptions, failures of telecommunication connections, or caused by force majeure,
  3. the Attendees’  actions which are inconsistent with these Terms, including damage caused to third parties as a result of the participation in the Hackathon in a manner contrary to these Terms and the law,
  4. provision of third parties’ data by the Attendees during the Hackathon,
  5. consequences of the providing false, incomplete or incorrect data, including data in the form,  by Attendees, 
  6. interruptions or difficulties in participation in the Hackathon for other reasons attributable to the Attendees, e.g., an overflowing mailbox, failure to register, or late registration an account on the necessary platforms indicated in the regulations,
  7. inability or difficulty in participation in the Hackathon due to non-fulfillment of the technical requirements specified in these Terms,
  8. for the correctness and accuracy of the guidance and information from the Mentor, which the Mentor provides to the Participants as part of consultation and support during the Competitions,
  9. the usefulness and usability of the lectures for the Attendees during the Hackathon and the assimilation of this knowledge by them, with the Organizer making every effort to select speakers who provide a guarantee of high-quality content.
  1. THE ATTENDEES OBLIGATIONS
  1. Zero Hunger Hackathon is a community event intended for learning, collaboration, and engagement in creating digital solutions with social impact. All Attendees and Judges are expected to show respect and courtesy to others through the event.
  2. Hackathon Attendees  shall demonstrate conduct that does not pose any threat to the safety of other Attendees, observe the law and these Terms, as well as immediately follow the instructions of the Organizer.
  3. The Attendees shall respect the rights and personal dignity of other people who are participating in the Hackathon. Harassment of others is strictly prohibited.  Harassment shall be deemed as: offensive verbal comments on sex, gender, age, sexual orientation, disability, physical appearance, body size, race, ethnicity, or religion, as well as intentional intimidation, persecution, improper physical contact, and unwanted sexual attention. In addition, during the Hackathon, it shall be prohibited to use words and symbols commonly recognized as prohibited, including rude language or expressions that may offend religious or ideological feelings, or imply discrimination.
  4. The Attendees shall promptly notify the Organizer of any instances of misconduct (in particular those indicated above) by the others.
  5. The Attendees are also obliged in particular to:
  1. provide the Organizer only with accurate, current, and all necessary data in connection with the Hackathon and promptly update these data; 
  2. participate in the Hackathon in a manner consistent with applicable law and without infringing on third-partys rights, as well as with customary practice and rules of social coexistence, in particular by not providing unlawful content;
  3. respect Organizer’s and other person’s rights, including copyrights and intellectual property rights, to the website and copyright materials,
  4. refrain from transferring third-party data, including personal data,  or disclosing any confidential or classified information to others during the Hackathon. 
  5. complete the required registrations on the designated platforms in time to allow the participant to participate in the Hackathon without interruption.
  1. The Organizer is entitled to exclude from participation in the Hackathon with immediate effect any Attendee who, despite being requested to cease a breach of these Terms, fails to comply with the Organizer’s instructions, in particular, if their conduct poses a threat to the safety of the others or if they disrupt the proceedings of the Hackathon. The excluded person is obliged to leave the Hackathon immediately and shall not be entitled to any claims against the Organizer.
  2. Each Attendee shall undertake to settle, at its own expense, any claims of third parties for the infringement of the rights of such third parties due to non-compliance with the actual status of the Attendee’s declaration contained in these Terms, and in the event that these claims are settled by Organizer or the third person, or that Organizer or third person is ordered to reimburse in full on a recourse basis, the claims paid, penalties or damages and all related expenses. Furthermore, the Attendee shall undertake to participate, at its own expense, in any pending judicial proceeding or extrajudicial procedure involving the Organizer or third person and arising from the circumstances referred to in the preceding sentence. 
  1. COMPLAINTS
  1. Each Participant may lodge complaints to the following e-mail address: [email protected]  or in writing to the address of the Organizer.
  2. A complaint concerning the proceedings of the Hackathon may be submitted within 14 days of the results being published. Complaints lodged after this lapse of the period will not be recognized.
  3. The complaint should contain at least the identification of the Participant, including name and surname, email address, description of objections, and request. If data or information included in the complaint needs to be supplemented before assessing the complaint on its merits, we will ask you to supplement it accordingly.
  4. The Organizer shall review any complaints within 14 days of their submission. The answer to the complaint will be sent to the e-mail address specified in the relevant notification or to the address of the sender indicated in the complaint letter.
  5. If the Organizer does not reply to a complaint within the deadline specified above, it shall be deemed that the complaint was granted, i.e., the Organizer considered the Participant’s statement or request as justified.
  6. PERSONAL DATA
  1. The entity acting as the controller of personal data shall be Tech To The Rescue Foundation, with its registered office, at ul. Hoża 86/410, 00-682 Warsaw, Poland, entered into the Register of Associations, Other Social and Professional Organizations, Foundations, and Independent Public Health Care Facilities kept by the District Court for the Capital City of Warsaw, XIII Commercial Department of the National Court Register under KRS number 0000937683, NIP (Tax Identification Number) 5272981322, which may be contacted at the following e-mail addresses: [email protected].

  1. FINAL PROVISION
  1. The rules for the provision of electronic services by the Organizer for the provision of enrollment forms are regulated by a separate document:  Website Terms Use.
  2. The Organizer reserves the right to make any changes to these Terms, including changing the date of the Hackathon or canceling it, for important reasons, such as a state of emergency, natural disaster withdrawal of all Partners and Sponsors, or a change in the law making it impossible to organize the Hackathon in the currently indicated manner. 
  3. The Attendee will be notified of any change made to these Terms within a window of 14 days prior to the implementation of such a change. 
  4. The Organizer may at any time:
    • implement prizes, awards, and entitlements for Participants in connection with winning the Competition,
    • Extending the deadlines provided for these Terms does not prejudice the rights of Participants and does not constitute a change to these Terms.
  5. Except as provided by applicable law, the law of Poland will be the applicable law to recognize disputes and issues related to Hackathon.
